Terms of Service

1.1 About Slowburn

Slowburn ("we", "us", "our") operates a web platform that uses artificial intelligence to host long-form roleplay with user-created and platform-provided fictional characters. References to "Slowburn" in these terms include the people who run it and the entities that may take over its operation in the future.

1.2 About the service

The service includes the Slowburn website, any companion applications, the AI companions hosted on the platform, the user accounts associated with it, and the community spaces we operate (including our Discord). When these terms refer to "the service", they refer to all of the above.

Your use of the service is governed by these terms, our Content Policy, our Community Guidelines, and our Privacy Policy, each of which is incorporated by reference. If any of those documents conflict with this one, this one wins.

If you do not understand any part of these terms, please do not use the service. We are happy to clarify before you accept.

3.1 Age requirements

You must be at least 18 years old to use the service. We do not accept users under 18 under any circumstances. Accounts that we believe belong to a minor will be terminated. Some of the content hosted on the platform is intended for adults, and verifying age is part of how we keep that content away from the people it is not appropriate for.

3.2 Legal capacity

You must have the legal capacity to enter into this agreement in your jurisdiction. By using the service you confirm that you do.

4.1 Content on the service

The service includes text, images, AI-generated outputs, software, and other materials, whether provided by you, by Slowburn, or by third parties (collectively, "Content"). Each piece of Content is the responsibility of the person or entity that provides it. We are not obligated to host any particular piece of Content, and we may remove Content that violates these terms or the documents referenced in section 2.

4.2 Your information

Our Privacy Policy describes how we handle the information we collect about you. It is part of this agreement.

5.1 License grant

We grant you a limited, non-transferable, non-exclusive, revocable license to access and use the service for your own personal, non-commercial purposes, subject to these terms.

5.2 Restrictions

You will not:

• Access, reproduce, redistribute, sell, license, or otherwise exploit any part of the service or any Content, except as expressly authorized by these terms or by the copyright holder.
• Circumvent or interfere with any security, rate-limiting, or content-moderation feature of the service.
• Use automated systems, scrapers, or bots to access the service, except for public search engines crawling in accordance with our robots.txt or with our prior written permission.
• Collect or harvest personal information about other users without their consent.
• Use the service to send spam, unsolicited promotional content, or mass solicitations.
• Manipulate engagement metrics or otherwise misrepresent how Content performs on the service.
• Misuse the reporting, appeals, or moderation processes.
• Use the service to transmit unlawful, defamatory, threatening, or otherwise harmful Content.

5.3 Reservation

Using the service does not give you ownership of, or any intellectual-property rights to, the service itself, the Content provided by Slowburn, or the Content posted by other users.

6.1 Uploading content

If you have a Slowburn account, you may upload Content to the service. You are responsible for the Content you upload, and it must comply with these terms and the documents referenced in section 2. Do not upload Content that contains material you do not have the right to use.

6.2 Rights you grant

You retain ownership of the Content you upload. By uploading it, you grant the licenses described below.

6.3 License to Slowburn

You grant Slowburn a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, perform, display, prepare derivative works of, and distribute the Content you upload, solely in connection with operating, providing, and improving the service. This license includes the right to use Content for promotional or marketing purposes related to Slowburn.

6.4 License to other users

When you make Content publicly available on the service, you grant other users a worldwide, non-exclusive, royalty-free license to access and use that Content through the service. This license does not authorize other users to copy or redistribute your Content outside the service.

6.5 Duration of license

The licenses you grant continue for a commercially reasonable period after you remove the Content from the service, to allow caches, backups, and downstream copies to be retired.

6.6 Removing your content

You may remove your Content from the service at any time. You must remove Content if you no longer have the rights required to keep it posted.

6.7 Removal of content by Slowburn

We may remove Content that breaches these terms, the Content Policy, or the Community Guidelines, or that we believe may cause harm to users, third parties, or the service. We will tell the creator why their Content was removed unless doing so would obstruct an investigation or violate the law.

6.8 Copyright infringement

If you believe your work has been used on Slowburn in a way that constitutes copyright infringement, please contact us at saltyraindev@gmail.com with a description of the work, where it appears on the service, and contact information we can use to follow up.

7.1 Termination by you

You can terminate your account at any time from your settings page or by contacting us at saltyraindev@gmail.com. Account deletion is described in our Privacy Policy.

7.2 Termination by Slowburn

We may suspend or terminate your account, with or without notice, if (a) you materially or repeatedly breach this agreement, (b) we are required to do so by law, or (c) we have a reasonable belief that your continued use of the service poses a risk to other users, to the service, or to us.

8.1 Warranty disclaimer

Except as expressly stated in this agreement or as required by applicable law, the service is provided "as is" without warranty of any kind. We do not warrant that the service will be available without interruption, that it will be error-free, that any particular Content will be accurate, or that it will meet your needs.

8.2 Limitation of liability

To the maximum extent permitted by law, Slowburn and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service. This limitation applies regardless of the legal theory under which the claim is brought.

8.3 Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Slowburn and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, your violation of any third-party right, or any claim that your Content caused damage to a third party.

8.4 Third-party links

The service may contain links to third-party sites and services. We do not control those sites, and we are not responsible for their content, their privacy practices, or anything that happens after you leave the service. Review the terms and privacy practices of each third-party site you visit.

9.1 Changes to this agreement

We may revise this agreement from time to time. When we make a material change, we will surface it before it takes effect. Continued use of the service after a change indicates acceptance of the revised agreement.

9.2 Continuation

If your use of the service ends, the sections titled "Other legal terms", "About this agreement", and the licenses you granted in section 6 will continue to apply.

9.3 Severance

If any part of this agreement is held unenforceable, that part will be modified to the minimum extent necessary to make it enforceable, and the rest of the agreement will remain in effect.

9.4 No waiver

If we do not take action in response to a particular breach, we are not waiving our right to act on later breaches.

9.5 Interpretation

In this agreement, "including" means "including without limitation". Examples are illustrative rather than exhaustive.
